Terms of Service

By using Embrace, you agree to these terms. If you disagree, do not use the app.

1. Acceptance of Terms

These Terms of Service ("Terms") govern your use of Embrace ("the App", "Service"). By downloading, installing, or using Embrace, you agree to be bound by these Terms.

We may update these Terms. Continued use after updates constitutes acceptance. Material changes will be notified in-app.

2. Eligibility

You must be at least 18 years old to use Embrace. By using the App, you represent that you meet this requirement.

3. Account

Registration

You may use Embrace anonymously or create an account via email, Apple, or Google sign-in.

Your Responsibilities

  • Maintain accurate account information
  • Keep your device and credentials secure
  • You are responsible for all activity under your account

Account Termination

You may delete your account at any time via Settings. We may suspend or terminate accounts that violate these Terms.

4. Your Content

Ownership

You retain ownership of all content you create in Embrace, including essences, packs, and posts. We claim no intellectual property rights over your content.

Public Sharing: When you share content publicly (such as packs or posts), that content becomes available to other users in the Embrace ecosystem. Other users may view, embrace, and build upon publicly shared content.

License to Us

By sharing content publicly, you grant us and other Embrace users a license to display, distribute, and use that content as part of the Service. This license ends when you delete the content, though copies embraced by other users may persist.

Your Responsibilities

You are responsible for your content. Do not post content that:

  • Violates any law
  • Infringes others' rights
  • Is harmful, abusive, or harassing
  • Contains malware or spam

Embrace reserves the right to suspend or remove users and content that violate these guidelines or our community policies.

5. Subscriptions & Payments

Free and Paid Tiers

Embrace offers free features and optional paid subscriptions.

Billing

  • Payments processed via Apple App Store
  • Subscriptions auto-renew unless canceled 24 hours before period ends
  • Manage subscriptions in Apple ID settings
  • We do not have access to your payment details

Refunds

Refund requests are handled by Apple per their policies.

6. Acceptable Use

You agree NOT to:

  • Reverse engineer, decompile, or disassemble the App
  • Use the App for illegal purposes
  • Attempt to access other users' data
  • Interfere with App operation
  • Use automated systems to access the App
  • Impersonate others or falsely claim affiliation with Embrace

7. Intellectual Property

Our Property

Embrace, including its design, code, features, and branding, is owned by us and protected by intellectual property laws. These Terms do not grant you rights to our trademarks or branding.

Feedback

If you provide feedback or suggestions, we may use them without obligation to you.

8. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.

We do not warrant that:

  • The App will be uninterrupted or error-free
  • The App will meet your specific requirements
  • Results from the App will be accurate or reliable

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

We are NOT liable for:

  • Indirect, incidental, special, or consequential damages
  • Loss of data, profits, or goodwill
  • Damages arising from your use or inability to use the App
  • Any content or conduct of third parties
  • Any health outcomes or psychological effects

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR 100 USD, WHICHEVER IS GREATER.

Some jurisdictions do not allow liability limitations. In such cases, our liability is limited to the minimum extent permitted by law.

10. Indemnification

You agree to indemnify and hold us harmless from claims, damages, or expenses arising from:

  • Your use of the App
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Your content

11. Termination

By You

Delete your account anytime via Settings.

By Us

We may suspend or terminate your access if you violate these Terms, with or without notice.

Effect of Termination

Upon termination: your license to use the App ends, we may delete your data (per our Privacy Policy), and provisions that should survive termination will survive (liability, indemnification, disputes).

12. Governing Law & Disputes

Governing Law

These Terms are governed by the laws of Turkey, without regard to conflict of law principles.

Dispute Resolution

Any disputes shall be resolved in the courts of Turkey. You consent to personal jurisdiction in these courts.

Informal Resolution

Before filing a claim, you agree to contact us and attempt to resolve the dispute informally for at least 30 days.

13. General Provisions

  • Entire Agreement: These Terms, together with our Privacy Policy and Safety Disclaimer, constitute the entire agreement between you and us.
  • Severability: If any provision is found unenforceable, the remaining provisions remain in effect.
  • No Waiver: Our failure to enforce any right does not waive that right.
  • Assignment: We may assign these Terms. You may not assign your rights without our consent.
